Terms of use

These Terms of use (“Terms”) govern your use of the Paluwagan app and website (together, the “Service”). By using the Service, you agree to these Terms. Please read them together with our Privacy policy and Responsible use guidelines.

1. Who we are

The Service is operated by Paluwagan by Kabuhayan, a sole proprietorship registered with the Department of Trade and Industry (DTI) of the Philippines, with a registered address at Zone 1 Maycatmon, Milaor, Camarines Sur 4413, Philippines (BIR RSN 065RC20260000006791). In these Terms, “we,” “us,” and “Paluwagan” refer to this business.

2. What Paluwagan is, and what it is not

Paluwagan is a tool that helps a group organize and record a rotating savings circle (a paluwagan). It confirms and logs contributions, shows the payout order, and keeps a shared history that members can see.

• Paluwagan does not hold, move, store, or transmit your money. Members pay each round’s recipient directly.
• Paluwagan is not a bank, e-wallet, money transfer service, lender, investment product, or insurer.
• A paluwagan returns exactly what you put in. There is no interest, yield, or profit. It is savings, not an investment.

3. Eligibility

You must be at least 18 years old and able to enter into a binding agreement to use the Service. By using the Service, you confirm that you meet these requirements and that the information you provide is accurate.

4. Your account

You are responsible for keeping your login credentials secure and for activity that happens under your account. Tell us promptly if you believe your account has been used without your permission.

5. Organizing and joining circles

An organizer sets up a circle, including the contribution amount, schedule, members, and payout order, which is shown to all members before the circle begins. By joining a circle you agree to its terms as shown in the app. The trust and the obligation to pay live within your group; Paluwagan records and displays the arrangement but is not a party to it.

6. Payments between members

All payments are made directly between members using whatever method your group chooses (for example cash, a bank transfer, or an e-wallet). Paluwagan is not involved in, and is not responsible for, those transfers. Recording a payment in the app is a shared statement by the members; it is not proof issued by Paluwagan that funds cleared.

7. Acceptable use

You agree not to use the Service to break the law, to defraud or mislead others, to run a lending or investment scheme, or to interfere with the Service’s operation or security. We may suspend or end access that violates these Terms.

8. Fees

Joining the waitlist is free, and using Paluwagan during our early launch is free. If we introduce fees in the future, we will tell you clearly before they apply.

9. Disclaimers and liability

The Service is provided “as is.” We work to keep it accurate and available but we do not guarantee that members will pay, that a circle will complete, or that the Service will be uninterrupted or error-free. To the extent permitted by law, we are not liable for losses arising from missed payments between members or from disputes within a circle.

10. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will let you know through the app or by email. Continuing to use the Service after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Republic of the Philippines. Any dispute will be handled by the appropriate courts of the Philippines.
